    1.2 Scope of Application

These Terms govern the use of the Quario Platform and all its features, including but not limited to: creation and management of Voice Cards, AI assistant, QR Code Designer, AR Manager, AR Studio, Quario Automations, Knowledge Base (RAG), Lead Hub, Page Builder, Event Manager, Account Visibility, Integrations Marketplace, and Sitemap Builder.

These Terms are drafted in compliance with Legislative Decree no. 206 of 6 September 2005 (Consumer Code), Legislative Decree no. 70 of 9 April 2003 (Electronic Commerce), Regulation (EU) 2016/679 (GDPR), and the European and national regulations applicable to digital services.

    2. Acceptance of Terms

Registration on the Platform and/or use of the services implies the full and unconditional acceptance of these Terms, the Privacy Policy, and the Cookie Policy. If the User does not intend to accept these Terms, they must not register and must not use the Platform.

In the event that the User acts in the name and on behalf of a legal entity (company, body, organization), they represent and warrant that they have the necessary powers to bind such entity to these Terms.

    3. Description of Services

3.1 Voice Card and AI Assistant

The Platform allows the creation of smart digital business cards ("Voice Cards"), each equipped with a conversational AI assistant powered by advanced language models (LLMs). The AI assistant responds to visitors based on the information configured by the creator (professional profile, services, Knowledge Base) and the set moderation rules. The User can customize the behavior of the AI through system instructions, multiple welcome messages, allowed and blocked topics, and multilingual moderation rules.

3.2 QR Code Designer and Watermark

The Platform offers an advanced designer for creating customized QR Codes (colors, shapes, logos, gradients, dot and eye styles). Export of QR Codes with a signed watermark (HMAC-SHA256) is currently unavailable: downloaded QR Codes do not contain a watermark. The public verification page checks signed metadata embedded in an SVG file; a valid check does not prove the image was not edited.

    3.3 Augmented Reality (AR)

The Platform offers Augmented Reality (AR) features for the Company, Business and Enterprise plans: AR Studio, for advanced creation with scenes, layers, timelines, and interactive triggers. AR experiences can be used by visitors via mobile browser without the need to install native applications.

    3.4 Quario Automations

Quario Automations is the integrated automation engine that allows creators to configure automated workflows based on events. Automations can be activated by triggers such as: new lead collected, conversation started, form filled, QR scan, scheduled event. Executable actions include: sending webhooks, notifications, CRM updates, sending emails, and integrations with third-party services (Google Calendar, Slack, etc.). Webhook authentication secrets are encrypted with AES-256-GCM and payloads are digitally signed with HMAC-SHA256.

3.5 Lead Hub and Form Builder

The Lead Hub centralizes visitor data collected through AI conversations and forms, allowing the User to view, filter, export, and manage their leads. The Form Builder allows the creation of custom forms with conditional logic and contextual presentation triggers (time-based, topic-based, or engagement score-based).

    3.6 Knowledge Base (RAG)

The Knowledge Base allows the uploading of documents (PDF, text, multimedia files) which are processed, indexed, and made available to the AI assistant through Retrieval-Augmented Generation (RAG) techniques. The Knowledge Base is available for the Freelancer, Company, and Enterprise plans.

    3.7 Analytics and Activity

The Platform provides analytical dashboards with Voice Card performance metrics (scans, conversations, leads collected, engagement rate, geographical origin) and an activity log for team operations traceability. Analytics is available for the Freelancer, Company, and Enterprise plans.

3.8 Page Builder and Sitemap Builder

The Platform includes a drag-and-drop Page Builder (based on Puck technology) for creating custom information pages and a Sitemap Builder for managing multi-page websites associated with Voice Cards. These features are available for the Company and Enterprise plans.

    3.9 Account Visibility and Discovery

The Account Visibility feature allows the User to make their Voice Card discoverable on the public map of Quario, configuring geographical visibility, discovery radius, and geolocation options. Available for the Freelancer, Company, and Enterprise plans.

    4. Registration and Account

    4.1 Registration Requirements

To access the Platform services, the User must create an account by providing true, accurate, and updated data. The User must be at least sixteen years old (or fourteen for residents in Italy, pursuant to art. 2-quinquies of the Privacy Code). In the case of minors, parental or legal guardian consent is required.

    4.2 Account Security

The User is responsible for the security of their access credentials and for all activities carried out under their account. The User is required to immediately notify the Provider of any unauthorized use of their account or breach of security by sending a communication to info@quario.ai.

    4.3 Team Account (Company)

Users with a Company plan can create a team and invite members with differentiated roles (Manager, Collaborator). The team owner is responsible for the activities of the invited members and the management of allocated credits. The maximum number of seats is defined by the subscribed plan.

    4.4 Enterprise Account

Users with an Enterprise plan have additional features for multi-organization management, advanced customization, and dedicated support, according to the specific contractually agreed conditions.

    5. Subscription Plans and Prices

    5.1 Available Plans

The Platform offers the following subscription plans:

    • Free: limited access with one Voice Card, trial credits included, basic features.
    • Freelancer: advanced features, multiple Voice Cards, Knowledge Base, Analytics.
    • Company: all Freelancer features, plus team management, AR Studio, Page Builder, Sitemap Builder, team activities.
    • Enterprise: all Company features, plus multi-organization, custom SLA, dedicated support, advanced compliance features.

    5.2 Credits

The credit system regulates access to the Platform's AI features. Plan credits ("plan credits") renew monthly on the subscription renewal date; credits purchased separately ("package credits") are persistent and not subject to expiration. Credit consumption varies based on the type of operation (AI conversation, RAG query, content generation).

The Provider reserves the right to modify the credit cost of operations, with at least 30 days' prior notice.

    5.3 Price Changes

The Provider reserves the right to change the prices of subscription plans and credit packages. Price changes will be communicated with at least 30 days' notice and will apply from the next renewal period. The User who does not intend to accept the price change may withdraw from the subscription before the next renewal without penalty.

    5.4 Billing and Payments

Payments are processed through Stripe, Inc., a PCI DSS Level 1 certified payment processor. The Provider does not directly store the credit card data of the Users. Invoices are issued electronically in compliance with Italian tax regulations (D.P.R. 633/72).

    5.5 Trial Period

The Free plan includes trial credits. Upon their exhaustion, the User may continue to access the Platform with limited features or upgrade to a paid plan. The User's data will be kept for a period of 90 days after the exhaustion of the trial credits, after which they may be deleted upon notice to the User.

    6. Right of Withdrawal

Pursuant to articles 52 and following of the Consumer Code (Legislative Decree 206/2005), the User who qualifies as a "consumer" (a natural person acting for purposes unrelated to their entrepreneurial, commercial, artisanal or professional activity) has the right to withdraw from the subscription contract within 14 (fourteen) days from the date of conclusion of the contract (subscription), without obligation to state the reasons and without penalties.

To exercise the right of withdrawal, the User must send an explicit communication to support-it@quario.ai or use the standard withdrawal form attached to the Consumer Code.

Exception:pursuant to art. 59, paragraph 1, letter a) of the Consumer Code, the right of withdrawal is excluded in the event that the performance of the digital service has fully begun with the consumer's prior express consent and acknowledgment of the loss of the right of withdrawal following full execution of the contract. The use of the Platform after subscription (including credit consumption) constitutes the start of the service execution.

In case of a valid withdrawal, the Provider will refund the payments received within 14 days of receiving the withdrawal notice, using the same payment method used for the initial transaction, minus the value of any credits already consumed.

    7. Obligations of the User
